Associated Person Transactions 2024 – The Tax Opportunities and Threats

Description

The tax rules are awash with market value requirements, tax liabilities triggered by everyday related party transactions, and in other cases tax concessions available for some transactions between associates.

This webinar will look at the associated person rules including:

  • Trust related asset transfers: in addition to the standard rules, what tax effects occur if a trust incorporates a company and then transfers income producing assets to the company or to a lower tax rate beneficiary?
  • Land tax rules: the transfer of land between associates can give rise to tax tainting (taxable land businesses), tax concessions (e.g. length of Brightline land ownership), or tax exemptions (e.g. relationship property or death related land transfers).
  • Other tax impacts: the dividend rules, depreciable assets, employment and FBT, trading stock, and winding-up companies with related party gains and the GST rules.

In this webinar we will identify when, companies, partnerships, trusts and other persons are associated, and identify which transactions are subject to these rules.
