In Part One we cover taking instructions and interviewing the will maker including:

  • Assets and Liabilities and ownership – including a robust discussion on the conversations you need to have with the will maker gifts that vest immediately upon death or later.
  • Children and partners/spouses – including difficult conversations you may need to have with the will maker
  • Assets offshore – advice to give the will maker
  • Capacity and Undue influence – navigating conversations during the interview
  • Documenting advice about legislation governing wills (PRA/FPA/TPA)
  • Ensuring will instructions are capable of being validated and storing the instructions after the will is drafted

Part Two will cover, drafting the will, file management, and risk management along with:

  • Review of and use of standard clauses
  • Use of plain English
  • The three certainties and will drafting
  • Minimizing mistakes or clauses that are open to misinterpretation
  • Review of sample will drafting clauses
  • Trusts Act 2019 and its application
  • Documenting wishes vs. actual gifts of property
  • Timeliness and minimising claims by beneficiaries
