Trust Series 2025 – Retirement and Appointment of Trustees

Description

Join our practical webinar to navigate the complexities of trustee transitions under Sections 116 to 120 of the Trusts Act 2019. Gain insights on ensuring a smooth handover, addressing AML/CFT considerations, overcoming common pitfalls, and more

Sections 116 to 120 of the Trusts Act 2019 provides for the divestment and vesting of trust property on the change of trustee. However, in practice there are many pitfalls and challenges to confront to ensure a smooth transition where there is a change of trustees.

This intensely practical webinar will consider what happens after the deed of retirement / appointment / removal is signed or the court order made and how to ensure an orderly hand over.

Matters covered in this webinar, which will be accompanied by a comprehensive paper and will conclude with a question and answer session, include:

  • practical aspects of the transfer of trust property to new / continuing trustees
  • AML/CFT considerations
  • how to address trustees who refuse to hand over core documents or put a price on doing so
  • common traps and pit falls
  • rehabilitating botched retirements and appointments
  • disclosure considerations, and
  • a case study that includes a comprehensive check list and work flow guidelines.
