Relationship Property Law 2022 - Preston v Preston - 28 June 2022 (On Demand)

Description

Where to from here?

This webinar will look at the recent Supreme Court decision of Preston v Preston and how it impacts on the court’s approach to a Section 182 claim.

Section 182 of the Family Proceedings Act 1980 is one of the few trust-busting mechanisms currently available that have “teeth” and the consequences of a successful Section 182 claim can be significant.

Complex issues can also arise where a spouse has brought assets into the relationship or the duration of the relationship is at the shorter end of the spectrum, as in Preston.

Understanding how the Supreme Court approached its analysis under Section 182 will arm you with the knowledge required to successfully make or defend a Section 182 claim.
