EPAs are part of New Zealand’s adult incapacity regime and provide the opportunity for donors to make choices about what should happen when they are well for when they are not able to act for themselves. They are a key document in New Zealander’s asset planning toolkits.
However, all too often they are executed and then put away and only dusted off and closely considered “when they are needed”. That means there can be real issues with the EPA. The worst-case scenario is the EPA is invalid, and an application for PPPR order(s) is required. This session looks at the importance of foresight in preparing EPAs.
It is timely to go back to basics and look at some of the recurring issues, Covid19 tips and tricks and other drafting aspects of EPAs, including the value of bespoke clauses and how best to use section M.
In-house experts will discuss topical issues such as Modification Order EPAs, overseas attorneys, the importance of checking the EPA is complete when executed, including the need to be signed by all successor attorneys, witnessing requirements and issues with completing the certificate.
