Contracting Out Agreements 2021

Description

The Good, The Bad and The Ugly

Relationships are becoming increasingly complicated in today’s society. This makes it more difficult to advise on how to structure contacting out agreements in a way that provides the most robust protection for clients.

The issues which existed at the time Section 21 of the Property (Relationships) Act 1976 was enacted are vastly different from the issues faced by people in relationships today.

This webinar is intended to provide guidance on how best to utilise contracting out agreements to the advantage of your client and understand the limitations of contracting out agreements.

The following matters will be covered:

  • How to address trust interests in a contracting out agreement
  • The extent to which a contracting out agreement should reflect a party’s entitlement under the PRA
  • Key clauses to include in a contracting out agreement
  • The danger of agreements reached during negotiations
  • Addressing spousal maintenance and economic disparity in a contracting out agreement
  • Ensuring a contracting out agreement withstands any future challenge
  • Who can enter into a contracting out agreement
  • Reasons for entering into a contracting out agreement
