Trust and Estate disputes, whether between trustees, trustees and beneficiaries or between trustees and third parties including advisers, spouses, partners or creditors have the potential to generate extraordinary costs and acrimony.

This webinar, which is relevant to all practitioners who advise on trust or estate matters, trustees, beneficiaries or parties to a relationship or creditor dispute involving a trust considers:

  • how trust disputes arise
  • options for internal and external resolution
  • what trust litigation looks like
  • the jurisdiction of the District Court, Family Court and High Court
  • the alternative dispute resolution provisions of the Trusts Act 2019, and
  • how to avoid or pro-actively manage trust disputes.

This webinar will start with an overview of recent trust disputes requiring the assistance of the court and will critically analyse the dispute and consider alternative courses of action that might have been available.

The webinar will then consider the fervent breeding ground of trust disputes that can be expected as beneficiaries explore the extent of their rights to information.

Particular consideration will be given to advice to trustees that is generated before and after litigation is contemplated by reference to the recent Supreme Court decision in Lambie Trustee Limited v Addleman.

The webinar will conclude with a question and answer session.
