This webinar, which is relevant to all practitioners who act as trustees or advise trustees or settlors of trusts, considers:

  • the role of the special trust advisor (formerly an advisory trustee)
  • delegation of trustee duties, and
  • the appointment of a custodian trustee.

This webinar will start with an overview of the role of the special trust adviser (a creature of statute rather than equity) and will then consider delegation and when it can be appropriate to appoint a custodian trustee.

The webinar will then look at the practical aspects and the drafting considerations relating to special trust advisers, delegation and custodian trustees.

Cases covered will include:

  • Oldfield v Oldfield [2020] NZHC 1401; [2020] NZHC 8; [2019] NZHC 492
  • Hills v Public Trust [2010] NZHC 400

The webinar will conclude with a question and answer session.
