Trusts are a common form of asset ownership. However, the rights and obligations associated with trusts, and even simple matters such as contracting with trusts are not always well understood. This course on trust fundamentals takes a case study approach to explore how and why trusts are settled, how to advise on trusts following the enactment of the Trusts Act 2019, when a trust is appropriate, when it might not be, best practice for on-going governance, dealing with incapacitated trustees, compliance obligations and how to manage adviser / settlor / trustee conflicts of interest.
Consideration will be given to the effect the Trusts Act 2019 will have on trust fundamentals.
