Charities Law Update 2019

Description

An update on recent and upcoming developments in charities law, including:

  • an update on the review of the Charities Act 2005, including feedback from the community engagement meetings held around the country during March and April 2019, a report back on the survey conducted during October 2018 to March 2019, and a comparison with similar reviews being undertaken in other jurisdictions, such as Australia and Scotland;
  • advocacy by charities, including the recent Better Public Media Trust decision, and a comparison with recent changes in Canada (including the Canada Without Poverty decision, which found that deregistration of a charity on the basis of its advocacy work breached the charity’s right to freedom of expression under the Canadian equivalent of section 14 of the New Zealand Bill of Rights Act 1990);
  • donee status update, including important changes made by the Taxation (Annual Rates for 2018-19, Modernising Tax Administration and Remedial Matters) Act 2019, as well as the September 2018 “wholly or mainly” interpretation statement, consultation on exclusive New Zealand funds, and debt forgiveness;
  • social enterprise update;
  • updates on other matters, including:
    • proposed new legislation for incorporated societies;
    • the Trusts bill;
    • other tax changes; and
    • the Tax Working Group report.

The webinar is intended to be suitable for those involved with charities, at whatever level, advanced or otherwise. It is intended to give both a theoretical overview as well as sufficient detail to be practical. Practitioners from both small and large firms should attend.
