“It is one thing to have a document declared to be a valid will but how about having that document admitted to probate?”

The application for grant of probate of a document that has been declared to be a valid will is not your straight forward application for probate. A number of matters need to be aligned to get it right.

This webinar will look at the basic steps to apply for an order to have a document declared a valid will and then move on to the post-order process to have that document admitted to probate to enable the estate to be administered in accordance with the provisions of that document.

To do this we will examine:

  • the requirements for preparing an application under the Wills Act for an order to have a document declared to be a valid will; 
  • the requirements for making an application under the Wills Act for orders to have a will corrected and; 
  • the requirements for making an application for a grant of probate of a document once it has been declared to be a valid will. 

This will include reviewing precedent forms for each process.

LEARNING OUTCOMES

Attendees will acquire an extensive knowledge of the processes involved to prepare these types of applications supported by an excellent set of precedent forms to assist in their preparation.
